DATENSCHUTZERKLÄRUNG

I. Allgemein

Trignostics GmbH, Traungasse 14-16, 1030 Wien, E-Mail: service@trignostics.com ("Trignostics GmbH", "wir", "uns") nimmt den Schutz Ihrer personenbezogenen Daten sehr ernst. Somit ist die Einhaltung der Bestimmungen des Datenschutzgesetzes und der Datenschutzgrundverordnung für uns selbstverständlich. Da das Vertrauen und die Zufriedenheit unserer Kunden das höchste Gut sind, werden personenbezogene Daten nur im notwendigen Umfang erhoben.

Wir informieren Sie über die von uns erhobenen und gespeicherten Daten sowie Ihre Betroffenenrechte. Zu diesem Zweck haben wir technische und organisatorische Maßnahmen getroffen, die sicherstellen, dass die Vorschriften über den Datenschutz sowohl von uns als auch von externen Dritten als unsere Dienstleister beachtet werden.

Die nachfolgende Erklärung gibt Ihnen einen Überblick darüber, wie wir diesen Schutz gewährleisten und welche Art von personenbezogenen Daten zu welchem Zweck erhoben werden.

II. Was sind personenbezogene Daten?

Personenbezogene Daten sind Angaben zu Ihrer Identität, wie beispielsweise Ihr Name, Adresse, Telefonnummer, E-Mail-Adresse, Geburtsdatum sowie Gesundheitsdaten.


III. Welche personenbezogenen Daten erfassen wir von Ihnen und wofür?

III.a. Kontaktaufnahme

Bei aktiver Kontaktaufnahme durch den Nutzer mit TRIGNOSTICS (zum Beispiel per E-Mail) werden die Daten und Angaben des Nutzers (Name, E-Mail-Adresse oder Telefonnummer) zwecks Bearbeitung der Anfrage sowie für den Fall, dass Anschlussfragen entstehen, sechs Monate gespeichert (vorvertragliche Maßnahmen bzw. berechtigte Interessen). Selbstverständlich übermitteln wir Ihre Anfrage nicht ohne Ihre Einwilligung an Dritte.

III.b. Bestellungen über den Webshop

Zum Zweck der Vertragsabwicklung werden wir die im Rahmen des Webshops angegebenen Informationen (Adresse, Telefonnummer, E-Mail-Adresse, Zahlungsdaten) und die ausgewählten Waren des Bestellers gespeichert. Die von Ihnen bereit gestellten Daten sind zur Vertragserfüllung bzw. zur Durchführung vorvertraglicher Maßnahmen erforderlich. Ohne diese Daten können wir den Vertrag mit Ihnen nicht abschließen. Eine Datenübermittlung an Dritte erfolgt nicht, mit Ausnahme der Übermittlung der Anschrift an das von uns beauftragte Versandunternehmen zur Zustellung der Ware, den ausgewählten Labors zur Auswertung von Tests, sowie an unseren Steuerberater zur Erfüllung unserer steuerrechtlichen Verpflichtungen. Aus Gründen der uns treffenden steuer- und unternehmensrechtlichen Aufbewahrungspflichten speichern wir Ihre im Zusammenhang mit Bestellungen zur Verfügung gestellten personenbezogenen Daten jedoch in der Regel sieben Jahre nach Vertragserfüllung.

III.c. Newsletter

Sofern Sie uns Ihre Einwilligung erteilt haben, informieren wir Sie mit dem Newsletter über Neuigkeiten über unsere aktuellen Angebote, Services, Aktionen, Veranstaltungen und Updates der TRIMEDICUM Gruppe, bestehend aus der TRIGNOSTICS GmbH und TRIMEDICUM GmbH, Traungasse 14-16, 1030 Wien, sowie der TRINICUM GmbH, Schwarzenbergplatz 6, 1030 Wien. Wenn Sie den Newsletter empfangen möchten, werden - sofern bekannt - Ihre Anrede, Titel, Vorname, Nachname, E-Mail-Adresse und Geburtsdatum verarbeitet. Weitere Daten werden nicht erhoben. Diese Daten werden nur für den Versand der Newsletter verwendet und werden nicht an Dritte weitergegeben. Mit der Anmeldung zum Newsletter speichern wir Ihre IP-Adresse und das Datum der Anmeldung. Diese Speicherung dient alleine dem Nachweis im Fall, dass ein Dritter eine E-Mail-Adresse missbraucht und sich ohne Wissen des Berechtigten für den Newsletter-Empfang anmeldet. Ihre Einwilligung zur Speicherung der Daten, der E-Mail-Adresse sowie deren Nutzung zum Versand des Newsletters können Sie jederzeit, kostenlos, ohne Angabe von Gründen und mit Wirkung für die Zukunft widerrufen. Der Widerruf kann über einen Link in den Newslettern selbst oder per Mitteilung an unser Team, wie zB unter datenschutz@trimedicum.com erfolgen. Wir speichern Ihre personenbezogenen Daten bis zu Ihrem Widerruf, jedoch nicht länger als für drei Jahre ab der letzten Kontaktaufnahme zu uns.

III.d. Cookies

Cookies sind kleine Dateien, die es ermöglichen, auf dem Zugriffsgerät der Nutzer (PC, Smartphone o.ä.) spezifische, auf das Gerät bezogene Informationen zu speichern. Sie dienen zum einem der Benutzerfreundlichkeit von Webseiten und damit den Nutzern (z.B. Speicherung von Logindaten oder Inhalte von Warenkörben). Zum anderen dienen sie, um die statistischen Daten der Webseitennutzung zu erfassen und sie zwecks Verbesserung des Angebotes analysieren zu können. Letztere setzten wir nur dann, wenn Sie uns Ihre Einwilligung hierfür auch erteilt haben. Sie können die Einwilligung auch jederzeit, kostenlos, ohne Angabe von Gründen und mit Wirkung für die Zukunft widerrufen. Auf dieser Webseite wird die Analysesoftware "Google Analytics" eingesetzt. Die letzten Zeichen Ihrer IP-Adresse werden anonymisiert gespeichert, und die Tracking-Cookies zum Zählen von wiederkehrenden Besuchern werden ohne Zustimmung nicht gesetzt.

III.e. Einbindung von Diensten und Inhalten Dritter

Es kann vorkommen, dass innerhalb dieses Onlineangebotes Inhalte Dritter sowie RSS-Feeds oder Grafiken von anderen Webseiten eingebunden werden. Dies setzt immer voraus, dass die Anbieter dieser Inhalte (nachfolgend bezeichnet als „Dritt-Anbieter") die IP-Adresse der NutzerInnen wahrnehmen, denn ohne die IP-Adresse könnten sie die Inhalte nicht an den Browser des jeweiligen Nutzers senden. Die IP-Adresse ist damit für die Darstellung dieser Inhalte erforderlich. Wir bemühen uns, nur solche Inhalte zu verwenden, deren jeweilige Anbieter die IP-Adresse lediglich zur Auslieferung der Inhalte verwenden. Jedoch haben wir keinen Einfluss darauf, falls die Dritt-Anbieter die IP-Adresse z. B. für statistische Zwecke speichern. Soweit dies uns bekannt ist, klären wir die NutzerInnen darüber auf. Die Verarbeitung erfolgt zur Darstellung unseres Online-Angebots, ist damit technisch notwendig und auf Basis unserer berechtigten Interessen bzw. zur Vertragserfüllung.

III.f. Social-Media-Plugins (Facebook, Instagram, LinkedIn, YouTube)

Es kann vorkommen, dass innerhalb dieses Onlineangebotes Social-Media-Plugins integriert sind. Aus Datenschutzgründen verwenden wir die 2-Klick-Lösung. Das heißt, erst, wenn Sie auf das entsprechende Icon klicken, werden die Social-Media-Plugins von Drittservern geladen und Daten wie Ihre IP-Adresse oder Browserkonfiguration übertragen bzw. Drittanbieter-Cookies auf Ihrem Rechner oder Smartphone gespeichert. Nach unserem Kenntnisstand erhalten die sozialen Netzwerke in diesem Fall Informationen darüber, welche unserer Webseiten Sie aktuell und zuvor aufgerufen haben. Durch die Plugins wird bei jedem Aufruf der betreffenden Webseite ein Cookie mit einer eindeutigen Kennung gesetzt. Hierdurch kann das soziale Netzwerk in die Lage versetzt werden, ein Profil über Ihr Nutzungsverhalten zu erstellen. Es ist nicht auszuschließen, dass Ihnen ein solches Profil auch im Fall einer späteren erstmaligen Registrierung bei dem sozialen Netzwerk zugeordnet werden kann. Daher erfolgt ein Datentransfer an die Social Media Betreiber nicht ohne ihre vorherige Einwilligung. Wir speichern die Daten für eine Dauer von 6 Monaten.

III.g. Verwaltung der Kundendaten

Darüber hinaus verarbeiten wir Ihre nicht-sensiblen Kundendaten – also keine Gesundheitsdaten – in unserer CRM-Datenbank. Rechtsgrundlage sind unsere berechtigten Interessen gemäß Art 6 Abs 1 lit f DSGVO an einer effizienten Kundenbetreuung und -verwaltung. Für die Datenverarbeitung im Rahmen der CRM-Datenbank sowie der Versendung des Newsletters (siehe Punkt 3.1.2.) auf Basis Ihrer vorherigen Einwilligung hierzu sind wir mit der TRIGNOSTICS GmbH und der TRIMEDICUM GmbH, Traungasse 14-16, 1030 Wien, sowie der TRINICUM GmbH, Schwarzenbergplatz 6. 1030 Wien, gemeinsam verantwortlich. Dementsprechend haben wir mit der TRIGNOSTICS GmbH und der TRIMEDICUM GmbH, sowie der TRINICUM GmbH eine Vereinbarung gemäß Art 26 DSGVO ("Joint Controller-Vereinbarung) abgeschlossen, die die datenschutzrechtliche Verteilung der Aufgaben und Pflichten regelt. Sie haben das Recht, Ihre Ansprüche unabhängig der Joint Controller-Vereinbarung gegenüber jedem Verantwortlichen geltend zu machen. TRIGNOSTICS GmbH ist als Single Point of Contact für die Wahrnehmung der Betroffenenrechte verantwortlich und übernimmt die direkte Kooperation und Kommunikation mit der Aufsichtsbehörde.

III.h. Nutzung der Web-App (Testregistrierung)

Trignostics verarbeitet Ihre personenbezogenen Daten (Name, Geburtsdatum, E-Mail-Adresse, Telefonnummer, Identifikationsnummer, Geschlecht, Herkunft) zwecks Registrierung in der Web-App gem Art 6 Abs 1 lit b DSGVO sowie zur Zuordnung der Probe zu den von Ihnen oder der Kontaktperson bekanntgegebenen Daten. Rechtsgrundlage hierfür ist Ihre ausdrückliche Einwilligung gem Art 9 Abs 2 lit a DSGVO. Wir verarbeiten auch Ihre Zugangsdaten zum Betrieb der Web-App. Rechtsgrundlage sind sowohl Ihre als auch unsere berechtigten Interessen gem Art 6 Abs 1 lit f DSGVO. Für den Betrieb der Web-App verwenden wir ausschließlich technisch notwendige Cookies, die für den Betrieb der Web-App und die Durchführung des Vaterschafts- bzw Verwandtschaftstests erforderlich sind. Rechtsgrundlage ist Ihr und unser berechtigtes Interesse gem Art 6 Abs 1 lit f DSGVO und § 165 Abs 3 TKG an der Bereitstellung einer funktionierenden Web-App.

III.i. Kontaktaufnahme und Auswertung von Proben

Trignostics verarbeitet die Ihnen zugewiesene Identifikationsnummer, Ihren Namen, bei Verwandtschaftsanalysen zusätzlich Ihr Geschlecht und Ihre ethnische Herkunft, sowie Ihre Probe im Zusammenhang mit der Auswertung des eingesendeten Tests. Das Probenmaterial wird im zertifizierten Labor, der Trinicum Lab GmbH, Traungasse 14-16, 1030 Wien ausgewertet. Rechtsgrundlage ist Ihre ausdrückliche Einwilligung gem Art 9 Abs 2 lit a DSGVO. Die Information über den Eingang des Testergebnisses wird als E-Mail versendet. Das Testergebnis kann über den im E-Mail angegebenen Link direkt im Portal abgerufen werden. Sollten Sie stattdessen eine Benachrichtigung auf dem Postweg wünschen, informieren Sie uns bitte unter service@trignostics.com. Bitte beachten Sie, dass dies einige Tage mehr in Anspruch nimmt als die reguläre Benachrichtigung.

Bei der Auswertung von Colon AIQ Tests verarbeitet Trignostics die Ihnen zugewiesene Probennummer, Ihren Namen, Geburtsdatum, Sozialversicherungsnummer, Geschlecht, Adresse, Telefonnummer, Emailadresse, Probenmaterial und Ihren persönlichen genetischen Bericht . Das Probenmaterial wird im zertifizierten Labor, der Clinomics Europe Ltd., Mihálkovics u. 10, 1094 Budapest, Ungarn ausgewertet. Rechtsgrundlage ist Ihre ausdrückliche Einwilligung gem Art 9 Abs 2 lit a DSGVO.


IV. Sicherheit Ihrer persönlichen Daten

TRIGNOSTICS und unsere IT-Dienstleister setzen sich dafür ein, dass sich Ihre persönlichen Angaben, die Sie auf unseren Servern speichern, in einer kontrollierten sicheren Umgebung befinden und vor unerlaubten Zugriff, Verwendung sowie Veröffentlichung geschützt sind. Der Serverstandort unserer IT-Dienstleister befindet sich in der EU (Österreich und Deutschland).

V. Nutzung und Weitergabe von Daten

TRIGNOSTICS behandelt Ihre Daten selbstverständlich vertraulich. Grundsätzlich stellen wir Ihre Daten daher Dritten nicht zur Verfügung, es sei denn, Sie haben hierzu ausdrücklich Ihre Einwilligung gegeben. Soweit wir gesetzlich oder per Gerichtsbeschluss dazu verpflichtet sind, geben wir Ihre Daten an auskunftsberechtigte staatliche Institutionen und Behörden weiter. Außerdem übermitteln wir Ihre personenbezogenen Daten im erforderlichen Ausmaß auch an externe Erfüllungsgehilfen oder Dienstleister: V.a. bei der Durchführung von Tests die eine Laborauswertung beinhalten
  • an die Trinicum Lab GmbH zur Auswertung der Proben
  • an den vidierenden Laborfacharzt für medizinische Proben
  • für Auswertungen von Colon AIQ Tests die Clinomics Europe Ltd., Mihálkovics u. 10, 1094 Budapest, Ungarn
  • an etwaige Dritte, die an der Erfüllung unserer Verpflichtungen Ihnen gegenüber mitwirken (etwa Logistikdienstleister, Betreiber der Web-Applikation) an sonstige externe Dritte im erforderlichen Ausmaß (zB Wirtschaftsprüfer, Versicherungen im Versicherungsfall, Rechtsvertreter im Anlassfall etc). Hier werden personenbezogene Daten, wenn möglich anonymisiert.
V.b. bei der Nutzung des Onlineshops
  • an IT-Dienstleister und/oder Anbieter von Datenhosting oder Datenverarbeitung oder ähnlichen Diensten;
  • an sonstige Dienstleister, Anbieter von Tools und Softwarelösungen, die uns ebenfalls bei der Erbringung unserer Leistungen unterstützen und in unserem Auftrag tätig werden;
  • etwaige Dritte, die an der Erfüllung unserer Verpflichtungen Ihnen gegenüber mitwirken (etwa Paketdienstleister bei der Zustellung Ihrer Webshop-Bestellung an Sie, Zahlungsdienstleister bei der Zahlungsabwicklung im Webshop, Banken zur Zahlungsabwicklung);
  • an sonstige externe Dritte im erforderlichen Ausmaß (zB Wirtschaftsprüfer, Versicherungen im Versicherungsfall, Rechtsvertreter im Anlassfall etc).
Falls personenbezogene Daten an Empfänger in Drittstaaten außerhalb der EU übermittelt werden und für den betreffenden Drittstaat kein Angemessenheitsbeschluss der EU-Kommission gemäß Art 45 DSGVO besteht, erfolgt die Übermittlung im Einzelfall vorbehaltlich geeigneter Garantien gem Art 46 DSGVO bzw gegebenenfalls durch Einwilligung für bestimmte Zwecke.

VI. Speicherdauer der Daten von Tests die eine Laborauswertung beinhalten

Wir speichern Ihre personenbezogenen Daten grundsätzlich nur so lange, als sie zur Zweckerfüllung notwendig sind.

Wir speichern Ihre personenbezogenen Daten für einen Zeitraum von zehn Jahren, um in einem möglichen Produkthaftungsverfahren aufgrund vermeintlicher Fehlerhaftigkeit des Labortests die erforderlichen Unterlagen vorlegen zu können. Rohdaten und Analysedaten werden nach spätestens einem Jahr gelöscht. Wir speichern Ihre personenbezogenen Daten im Anlassfall auch über die genannten Fristen hinaus, solange Rechtsansprüche aus dem Verhältnis zwischen Ihnen und Trignostics geltend gemacht werden können bzw zur endgültigen Klärung eines konkreten Vorfalles oder Rechtsstreits. Rechtsgrundlage dafür ist die Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen gem Art 9 Abs 2 lit f DSGVO. 

VII. Ihre Betroffenenrechte

Wenn Sie möchten, dann geben wir Ihnen jederzeit Auskunft über alle Ihre personenbezogenen Daten, die wir verarbeiten. Zusätzlich haben Sie auch in einigen Fällen ein Recht auf Datenportabilität und somit Herausgabe Ihrer uns bekannt gegebenen personenbezogenen Daten in einem strukturierten, gängigen und maschinenlesbaren Format.

Sie können unter bestimmten Voraussetzungen die Einschränkung der Verarbeitung sowie Berichtigung und Löschung Ihrer personenbezogenen Daten verlangen.

In einigen oben genannten Fällen ist Trignostics durch Ihre Einwilligung berechtigt, Ihre personenbezogenen Daten zu verarbeiten. Diese Einwilligung können Sie jederzeit ohne Angabe von Gründen mit Wirkung für die Zukunft widerrufen (etwa per E-Mail an service@trignostics.com).

Sie haben ein Recht auf Widerspruch und ein Beschwerderecht bei der Datenschutzbehörde (www.dsb.gv.at).

Für Fragen zu dieser Verarbeitung, die Ausübung Ihrer Rechte oder Fragen zum Datenschutz bei der Trignostics GmbH wenden Sie sich bitte per Mail an unseren Datenschutzbeauftragten unter datenschutz@trimedicum.com.

IX. Änderungen dieser Datenschutzerklärungen

Trignostics wird diese Datenschutzerklärung von Zeit zu Zeit an neue Prozesse unter Beachtung der geltenden Datenschutzbestimmungen ändern. Wir bitten Sie daher sich regelmäßig über die Datenverarbeitungsprozesse zu informieren. DATA PROTECTION DECLARATION

I. General

Trignostics GmbH, Traungasse 14-16, 1030 Vienna, email: service@trignostics.com (‘Trignostics GmbH’, “we”, ‘us’) takes the protection of your personal data very seriously. Compliance with the provisions of the Data Protection Act and the General Data Protection Regulation is therefore a matter of course for us. As the trust and satisfaction of our customers are our greatest assets, personal data is only collected to the extent necessary. We will inform you about the data we collect and store, as well as your rights as a data subject. To this end, we have taken technical and organisational measures to ensure that data protection regulations are observed both by us and by external third parties acting as our service providers. The following statement provides an overview of how we ensure this protection and what type of personal data is collected for what purpose. You are welcome to contact our data protection officer at datenschutz@trimedicum.com.


II. What is personal data?

Personal data is information about your identity, such as your name, address, telephone number, email address, date of birth and health data.


III. What personal data do we collect from you and for what purpose?

III.a. Contact

When users actively contact TRIGNOSTICS (e.g. by email), their data and details (name, email address or telephone number) are stored for six months for the purpose of processing the enquiry and in case any follow-up questions arise (pre-contractual measures or legitimate interests). We will not, of course, forward your enquiry to third parties without your consent.

III.b. Orders via the web shop

For the purpose of contract processing, we will store the information provided in the web shop (address, telephone number, email address, payment details) and the goods selected by the customer. The data you provide is necessary for the fulfilment of the contract or for the implementation of pre-contractual measures. Without this data, we cannot conclude the contract with you. No data will be transferred to third parties, with the exception of the transfer of the address to the shipping company commissioned by us to deliver the goods, to the selected laboratories for the evaluation of tests, and to our tax advisor for the fulfilment of our tax obligations. However, for reasons of tax and commercial law retention obligations applicable to us, we generally store your personal data provided in connection with orders for seven years after fulfilment of the contract.

III.c. Newsletter

If you have given us your consent, we will use the newsletter to inform you about news regarding our current offers, services, promotions, events and updates from the TRIMEDICUM Group, consisting of TRIGNOSTICS GmbH and TRIMEDICUM GmbH, Traungasse 14-16, 1030 Vienna, as well as TRINICUM GmbH, Schwarzenbergplatz 6, 1030 Vienna. If you would like to receive the newsletter, your title, first name, surname, email address and date of birth will be processed, if known. No further data will be collected. This data will only be used to send the newsletter and will not be passed on to third parties. When you register for the newsletter, we store your IP address and the date of registration. This storage serves solely as proof in the event that a third party misuses an email address and registers to receive the newsletter without the knowledge of the authorised person. You can revoke your consent to the storage of data, your email address and its use for sending the newsletter at any time, free of charge, without giving reasons and with effect for the future. The revocation can be made via a link in the newsletters themselves or by notifying our team, e.g. at datenschutz@trimedicum.com. We store your personal data until you revoke your consent, but for no longer than three years from the last contact with us.

III.d. Cookies

Cookies are small files that enable specific information relating to the device to be stored on the user's access device (PC, smartphone, etc.). On the one hand, they serve to improve the user-friendliness of websites and thus benefit users (e.g. storage of login data or shopping basket contents). On the other hand, they serve to collect statistical data on website usage and to analyse it for the purpose of improving the website. We only use the latter if you have given us your consent to do so. You can revoke your consent at any time, free of charge, without giving reasons and with effect for the future. The analysis software ‘Google Analytics’ is used on this website. The last characters of your IP address are stored anonymously, and tracking cookies for counting returning visitors are not set without consent.

III.e. Integration of third-party services and content

Third-party content, RSS feeds or graphics from other websites may be integrated into this online offering. This always requires that the providers of this content (hereinafter referred to as ‘third-party providers’) perceive the IP address of the users, because without the IP address they would not be able to send the content to the browser of the respective user. The IP address is therefore necessary for the display of this content. We endeavour to use only content whose respective providers use the IP address solely for the delivery of the content. However, we have no influence on whether third-party providers store the IP address for statistical purposes, for example. As far as we are aware of this, we inform users about it. Processing is carried out for the purpose of displaying our online offering, is therefore technically necessary and based on our legitimate interests or for the fulfilment of a contract.

III.f. Social media plugins (Facebook, Instagram, LinkedIn, YouTube)

Social media plugins may be integrated into this online offering. For data protection reasons, we use the 2-click solution. This means that only when you click on the corresponding icon will the social media plugins be loaded from third-party servers and data such as your IP address or browser configuration be transferred or third-party cookies be stored on your computer or smartphone. To the best of our knowledge, in this case the social networks receive information about which of our web pages you have currently visited and previously visited. Each time you visit the relevant website, the plugins set a cookie with a unique identifier. This enables the social network to create a profile of your usage behaviour. It cannot be ruled out that such a profile may also be assigned to you in the event of a subsequent first-time registration with the social network. Therefore, data will not be transferred to social media operators without your prior consent. We store the data for a period of 6 months.

III.g. Management of customer data

In addition, we process your non-sensitive customer data – i.e. no health data – in our CRM database. The legal basis for this is our legitimate interests pursuant to Art. 6(1)(f) GDPR in efficient customer service and management. We are jointly responsible with TRIGNOSTICS GmbH and TRIMEDICUM GmbH, Traungasse 14-16, 1030 Vienna, and TRINICUM GmbH, Schwarzenbergplatz 6, 1030 Vienna. Accordingly, we have concluded an agreement with TRIGNOSTICS GmbH, TRIMEDICUM GmbH and TRINICUM GmbH in accordance with Art. 26 GDPR (‘Joint Controller Agreement’), which regulates the distribution of tasks and obligations under data protection law. You have the right to assert your claims against each controller independently of the joint controller agreement. TRIGNOSTICS GmbH is responsible as the single point of contact for exercising the rights of data subjects and is responsible for direct cooperation and communication with the supervisory authority.

Trignostics processes your personal data (name, date of birth, email address, telephone number, identification number, gender, origin) for the purpose of registering you in the web app in accordance with Art. 6(1)(b) GDPR and for assigning the sample to the data provided by you or your contact person. The legal basis for this is your explicit consent pursuant to Art. 9(2)(a) GDPR. We also process your access data for the operation of the web app. The legal basis for this is both your and our legitimate interests pursuant to Art. 6(1)(f) GDPR. For the operation of the web app, we only use technically necessary cookies that are required for the operation of the web app and the performance of the paternity or kinship test. The legal basis for this is your and our legitimate interest pursuant to Art. 6 (1) lit. f GDPR and § 165 (3) TKG in providing a functioning web app.

III.i. Contacting you and evaluating samples

Trignostics processes the identification number assigned to you, your name, and, in the case of kinship analyses, your gender and ethnic origin, as well as your sample in connection with the evaluation of the test you have submitted. The sample material is evaluated in the certified laboratory, Trinicum Lab GmbH, Traungasse 14-16, 1030 Vienna. The legal basis is your express consent pursuant to Art. 9 (2) (a) GDPR. Information about the receipt of the test result will be sent by email. The test result can be accessed directly in the portal via the link provided in the email. If you would prefer to receive notification by post instead, please inform us at service@trignostics.com. Please note that this will take a few days longer than regular notification. When evaluating Colon AIQ tests, Trignostics processes the sample number assigned to you, your name, date of birth, social security number, gender, address, telephone number, email address, sample material and your personal genetic report. The sample material is evaluated in the certified laboratory, Clinomics Europe Ltd., Mihálkovics u. 10, 1094 Budapest, Hungary. The legal basis for this is your express consent in accordance with Art. 9 (2) (a) GDPR.

TRIGNOSTICS and our IT service providers are committed to ensuring that your personal information stored on our servers is kept in a controlled, secure environment and protected from unauthorised access, use and disclosure. Our IT service providers' servers are located in the EU (Austria and Germany).

We only store your personal data for as long as it is necessary to fulfil the purpose.

We store your personal data for a period of ten years in order to be able to present the necessary documents in the event of possible product liability proceedings due to alleged defects in the laboratory test. Raw data and analysis data are deleted after one year at the latest. We also store your personal data beyond the aforementioned periods if necessary, as long as legal claims arising from the relationship between you and Trignostics can be asserted or for the final clarification of a specific incident or legal dispute. Ai fini dell’elaborazione del contratto, conserveremo le informazioni fornite durante l’utilizzo dello shop online (indirizzo, numero di telefono, indirizzo e-mail, dati di pagamento), nonché i nomi dei prodotti selezionati dall’acquirente. I dati da Lei forniti sono necessari per l’adempimento del contratto o per l’esecuzione di misure precontrattuali. In assenza di tali dati non saremo in grado di concludere il contratto con Lei. I dati non verranno trasmessi a terzi, ad eccezione dell’indirizzo, che verrà trasmesso al servizio di spedizione incaricato della consegna della merce, ai laboratori selezionati per l’analisi dei test, nonché al nostro consulente fiscale per l’adempimento dei nostri obblighi fiscali. Per motivi legati agli obblighi di conservazione previsti dal diritto fiscale e societario, conserveremo i Suoi dati personali forniti in relazione agli ordini generalmente per un periodo di sette anni dopo l’adempimento del contratto.

III.f. Plugin dei social media (Facebook, Instagram, LinkedIn, YouTube)

All’interno della nostra offerta online possono essere integrati plugin di social media. Per motivi di protezione dei dati, utilizziamo la soluzione a due clic. Ciò significa che i plugin dei social media verranno caricati dai server terzi solo dopo aver cliccato sull’icona corrispondente, trasmettendo in questo modo dati come l’indirizzo IP o la configurazione del browser, oppure memorizzando cookie di terze parti sul Suo dispositivo. Secondo le nostre conoscenze, in questo modo i social network ricevono informazioni sulle pagine del nostro sito che l’utente sta visitando o ha già visitato. Ogni volta che si accede a una pagina con plugin, viene impostato un cookie con un identificativo univoco. Questo potrebbe consentire al social network di creare un profilo relativo al comportamento di navigazione dell’utente. III.h. Utilizzo della Web-App (registrazione ai fini del test)

Trignostics tratta i Suoi dati personali (nome, data di nascita, indirizzo e-mail, numero di telefono, numero identificativo, sesso, origine) ai sensi dell’art. 6 par. 1 lett. b del GDPR ai fini della registrazione nella web app, nonché per l’associazione del campione ai dati forniti da Lei o dalla persona di contatto. La base giuridica per questo trattamento è il Suo consenso esplicito, basato sull’art. 9, par. 2 lett. a del GDPR. Trattiamo anche i Suoi dati di accesso per il funzionamento della web app. La base giuridica è costituita sia dal Suo sia dal nostro interesse legittimo ai sensi dell’art. 6 par. 1 lett. f del GDPR. Per il funzionamento della web app utilizziamo esclusivamente cookie tecnicamente necessari, richiesti per il funzionamento dell’applicazione web e per l’esecuzione dei test di paternità o parentela. La base giuridica è costituita dal nostro e dal Suo interesse legittimo alla fornitura di una web app funzionante, ai sensi dell’art. 6 par. 1 lett. f del GDPR e della sezione 165 par. 3 TKG (legge austriaca sulle telecomunicazioni).

Trignostics elabora il numero identificativo a Lei assegnato, il Suo nome, e, per le analisi di parentela, anche il Suo sesso e la Sua origine etnica, oltre al campione, in relazione all’analisi del test inviato. Il materiale biologico viene analizzato presso un laboratorio certificato, Trinicum Lab GmbH, Traungasse 14-16, 1030 Vienna.La base giuridica è il Suo consenso esplicito ai sensi dell’art. 9 par. 2 lett. a del GDPR. La comunicazione dell’avvenuta analisi del campione Le verrà inviata tramite e-mail. Il risultato del test può essere consultato direttamente nel portale tramite il link indicato nell’e-mail. Se preferisce ricevere la notifica per posta, La preghiamo di comunicarcelo tramite e-mail all’indirizzo service@trignostics.com. La notifica per posta può richiedere alcuni giorni in più rispetto alla comunicazione elettronica standard. Nel valutare i test Colon AIQ, Trignostics elabora il numero di campione assegnato all'utente, il suo nome, la data di nascita, il numero di previdenza sociale, il sesso, l'indirizzo, il numero di telefono, l'indirizzo e-mail, il materiale del campione e il suo referto genetico personale. Il materiale campione viene valutato nel laboratorio certificato Clinomics Europe Ltd., Mihálkovics u. 10, 1094 Budapest, Ungheria. La base giuridica è il tuo consenso esplicito ai sensi dell'art. 9 (2) (a) GDPR.


IV. Sicurezza dei Suoi dati personali

TRIGNOSTICS e i nostri fornitori IT si impegnano a garantire che i Suoi dati personali memorizzati sui nostri server vengano conservati in un ambiente sicuro e controllato e siano protetti da accesso, uso e divulgazione non autorizzati. I server dei nostri fornitori di servizi IT si trovano nell’Unione Europea, in Austria e in Germania.

Trasmettiamo i Suoi dati personali, nella misura necessaria, anche a:
  • fornitori IT e/o provider di hosting, elaborazione dei dati o servizi simili;
  • altri fornitori di servizi, fornitori di strumenti e soluzioni software che ci supportano nell’erogazione dei nostri servizi e agiscono su nostro mandato;
  • eventuali terzi coinvolti nell’adempimento dei nostri obblighi contrattuali nei Suoi confronti (es. corrieri per la consegna degli ordini effettuati nello shop online, fornitori di servizi di pagamento, banche per l’elaborazione dei pagamenti);
  • altri terzi esterni nella misura necessaria (es. revisori dei conti, assicurazioni, in caso di sinistro, legali, in caso di controversia, ecc.).
Nel caso in cui i dati personali vengano trasferiti a destinatari in Paesi terzi al di fuori dell’UE senza una decisione di adeguatezza della Commissione UE ai sensi dell’art. 45 del GDPR, il trasferimento avviene caso per caso, previa adozione di garanzie adeguate ai sensi dell’art. 46 del GDPR oppure, se necessario, con il Suo consenso per finalità specifiche.

VI. Durata della conservazione dei dati relativi a test con analisi di laboratorio

In linea di principio, conserviamo i Suoi dati personali solo per il tempo necessario al conseguimento dello scopo per cui sono stati raccolti. I Suoi dati personali vengono conservati per dieci anni al fine di poter fornire la documentazione necessaria in un eventuale procedimento per responsabilità del prodotto dovuto a presunti errori del test di laboratorio. I dati grezzi e i dati di analisi vengono cancellati al più tardi dopo un anno. In caso di necessità, possiamo conservare i Suoi dati personali anche oltre i termini sopra indicati, se sussistono potenziali rivendicazioni legali nel rapporto tra Lei e Trignostics, oppure per chiarire in via definitiva uno specifico incidente o contenzioso legale. La base giuridica per tale conservazione è l’accertamento, l’esercizio o la difesa di un diritto legale ai sensi dell’art. 9 par. 2 lett. f del GDPR.

Nie mamy jednak wpływu na to, czy dostawcy zewnętrzni przechowują adres IP np. w celach statystycznych. Jeśli posiadamy taką wiedzę, informujemy o tym użytkowników. Przetwarzanie danych odbywa się w celu prezentacji naszej oferty online, co jest technicznie niezbędne i oparte na naszym uzasadnionym interesie lub konieczne do wykonania umowy..

III.f. Wtyczki mediów społecznościowych (Facebook, Instagram, LinkedIn, YouTube)

W ramach tej oferty online mogą być zintegrowane wtyczki mediów społecznościowych. Ze względów ochrony danych stosujemy tzw. rozwiązanie dwóch kliknięć. Oznacza to, że dopiero po kliknięciu odpowiedniej ikony, wtyczki mediów społecznościowych są ładowane z serwerów zewnętrznych, a dane takie jak adres IP lub konfiguracja przeglądarki są przesyłane lub pliki cookie osób trzecich są zapisywane na Państwa komputerze lub smartfonie. Zgodnie z naszą wiedzą, media społecznościowe uzyskują w takim przypadku informacje o tym, które z naszych stron internetowych zostały przez Państwa odwiedzone – zarówno aktualnie, jak i wcześniej. Ponadto przetwarzamy niewrażliwe dane osobowe klientów – czyli bez danych o stanie zdrowia – w naszej bazie danych CRM. Podstawą prawną są nasze uzasadnione interesy zgodnie z art. 6 ust. 1 lit. f RODO, polegające na efektywnej obsłudze i zarządzaniu klientami. W zakresie przetwarzania danych w ramach bazy danych CRM oraz wysyłki newslettera (zob. punkt 3.1.2) na podstawie uprzednio wyrażonej zgody, działamy wspólnie z TRIGNOSTICS GmbH i TRIMEDICUM GmbH, Traungasse 14–16, 1030 Wiedeń, oraz TRINICUM GmbH, Schwarzenbergplatz 6, 1030 Wiedeń. W związku z tym zawarliśmy z TRIGNOSTICS GmbH i TRIMEDICUM GmbH umowę zgodnie z art. 26 RODO (Umowa o współadministrowanie – „Joint Controller Agreement”), która reguluje podział zadań i obowiązków w zakresie ochrony danych osobowych. Mają Państwo prawo dochodzić swoich roszczeń wobec każdego ze współadministratorów, niezależnie od ustaleń w umowie o współadministrowanie. TRIGNOSTICS GmbH pełni funkcję głównego punktu kontaktowego (Single Point of Contact) w zakresie realizacji praw osób, których dane dotyczą, oraz zajmuje się bezpośrednią współpracą i komunikacją z organem nadzorczym. e.

III.h. Korzystanie z aplikacji internetowej (rejestracja do testów)

Trignostics przetwarza Państwa dane osobowe (imię i nazwisko, data urodzenia, adres e-mail, numer telefonu, numer identyfikacyjny, płeć, pochodzenie) w celu rejestracji w aplikacji internetowej zgodnie z art. 6 ust. 1 lit. b RODO, a także w celu przyporządkowania próbki do danych przekazanych przez Państwa lub osobę kontaktową. Podstawą prawną jest w tym przypadku Państwa wyraźna zgoda na podstawie art. 9 ust. 2 lit. a RODO. Przetwarzamy również Państwa dane dostępowe w celu działania aplikacji internetowej. Podstawą prawną są zarówno Państwa, jak i nasze uzasadnione interesy zgodnie z art. 6 ust. 1 lit. f RODO. W ramach obsługi aplikacji internetowej używamy wyłącznie technicznie niezbędnych plików cookie, które są konieczne do działania aplikacji oraz do przeprowadzenia testów na ojcostwo lub pokrewieństwo. Trignostics przetwarza przydzielony Państwu numer identyfikacyjny, Państwa imię i nazwisko, a w przypadku analiz pokrewieństwa również płeć i pochodzenie etniczne, oraz Państwa próbkę, w związku z analizą przesłanego testu. Materiał próbki jest analizowany w certyfikowanym laboratorium Trinicum Lab GmbH, Traungasse 14–16, 1030 Wiedeń. Podstawą prawną jest Państwa wyraźna zgoda zgodnie z art. 9 ust. 2 lit. a RODO. Informacja o dostępności wyniku testu jest przesyłana drogą mailową. Dostęp do wyniku testu można uzyskać bezpośrednio w portalu za pośrednictwem linku podanego w wiadomości e-mail. Jeśli chcą Państwo otrzymać powiadomienie pocztą, prosimy o kontakt na adres: service@trignostics.com. Należy pamiętać, że taka forma dostarczenia informacji może zająć kilka dni więcej niż standardowe powiadomienie drogą elektroniczną.

Podczas oceny testów Colon AIQ firma Trignostics przetwarza przypisany Państwu numer próbki, imię i nazwisko, datę urodzenia, numer ubezpieczenia społecznego, płeć, adres, numer telefonu, adres e-mail, materiał próbki oraz Państwa osobisty raport genetyczny. Materiał próbki jest oceniany w certyfikowanym laboratorium w firmie Clinomics Europe Ltd., Mihálkovics u. 10, 1094 Budapeszt, Węgry. Podstawą prawną jest Państwa wyraźna zgoda zgodnie z art. 9 ust. 2 lit. a RODO.


IV. Bezpieczeństwo Państwa danych osobowych

TRIGNOSTICS oraz nasi dostawcy usług IT dokładają wszelkich starań, aby Państwa dane osobowe przechowywane na naszych serwerach znajdowały się w kontrolowanym i bezpiecznym środowisku, chronionym przed nieuprawnionym dostępem, wykorzystaniem lub ujawnieniem. Serwery naszych dostawców usług IT znajdują się na terenie UE (Austria i Niemcy).

V. Wykorzystanie i udostępnianie danych

TRIGNOSTICS traktuje Państwa dane z najwyższą poufnością. Co do zasady nie udostępniamy danych osobom trzecim, chyba że wyrażą Państwo na to wyraźną zgodę. Jeśli jednak jesteśmy zobowiązani na podstawie przepisów prawa lub nakazu sądowego, przekazujemy dane uprawnionym instytucjom państwowym.   • • do innych zewnętrznych podmiotów trzecich w niezbędnym zakresie (np. biegli rewidenci, towarzystwa ubezpieczeniowe w razie zgłoszenia szkody, pełnomocnicy prawni w razie potrzeby). Dane osobowe są w takich przypadkach – o ile to możliwe – anonimizowane.
V.b. w przypadku korzystania ze sklepu internetowego
  • do dostawców usług IT i/lub dostawców hostingu danych lub przetwarzania danych albo podobnych usług;

VI. Okres przechowywania danych dotyczących testów wymagających analizy laboratoryjnej

Dane osobowe przechowujemy zasadniczo tylko przez taki czas, jaki jest konieczny do realizacji celu. Dane osobowe przechowujemy przez okres dziesięciu lat, aby móc przedstawić wymagane dokumenty w przypadku ewentualnego postępowania z tytułu odpowiedzialności za produkt na skutek rzekomej nieprawidłowości testu laboratoryjnego. Nieprzetworzone dane i dane analityczne są usuwane najpóźniej po upływie jednego roku. Dane osobowe przechowujemy w razie potrzeby również po upływie wyżej wskazanego okresu – dopóki możliwe jest dochodzenie roszczeń prawnych wynikających ze stosunku między Państwem a Trignostics lub do czasu ostatecznego wyjaśnienia konkretnego incydentu lub sporu. Podstawą prawną jest dochodzenie, wykonywanie lub obrona roszczeń zgodnie z art. 9 ust. 2 lit. f RODO
